Welcome to Faefold. These Terms of Service, together with any policies referenced in them, govern your access to and use of our website, products, content, features, tools, and services. By visiting our website, creating an account, placing an order, submitting content, or otherwise using our services, you agree to these Terms and to our Privacy Policy.

Please read these Terms carefully before using our website or placing an order. If you do not agree to these Terms or our Privacy Policy, please do not use our website or purchase from us.

1. About Faefold

This website is operated by FAEFOLD LLC. Throughout the website and these Terms, the terms “Faefold,” “we,” “us,” and “our” refer to FAEFOLD LLC.

Faefold offers thoughtfully designed cardboard playhouses and related products intended for children’s creative, screen-free, open-ended play under adult supervision.

Our website is intended for adults, parents, guardians, and caregivers. Our products are intended to be purchased by adults and used by children only in accordance with all product instructions, warnings, labels, and safety guidance.

2. Eligibility and Account Responsibility

By using our website or placing an order, you confirm that you are at least 18 years old, or the age of majority in your state or place of residence.

Children should not place orders, create accounts, submit personal information, or otherwise use this website without the involvement and supervision of a parent or legal guardian.

If you create an account or provide information to us, you agree to provide current, complete, and accurate information. You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to another person.

We do not knowingly collect personal information directly from children under 13 through this website. If you believe a child has provided personal information to us without appropriate parental consent, please contact us so we can review and take appropriate action.

3. Product Use and Safety

Faefold products are intended for indoor creative play only.

Our cardboard playhouses are not designed or intended for climbing, jumping, sitting, standing, leaning, rough play, sleeping, use as furniture, use as structural support, or use as a safety enclosure.

Adult assembly is required. Adult supervision is recommended during use.

Unless stated otherwise on the product page, product packaging, or product label, Faefold products are intended for children ages 3 and up.

You are responsible for making sure the product is appropriate for your child, your home, and the way the product is used. You agree to follow all assembly instructions, safety warnings, product labels, and use guidelines provided with the product.

Please use the product only on a flat, dry, stable indoor surface. Keep the product away from heat, open flames, candles, heaters, fireplaces, water, damp areas, sharp objects, pets that may damage the product, and any unsafe environment.

Do not use the product outdoors, in wet or humid conditions, near stairs, near traffic areas, near electrical hazards, or in any place where the product may become unstable or unsafe.

Stop using the product immediately if it becomes damaged, torn, bent, unstable, wet, weakened, or otherwise unsafe. Packaging materials, small parts, and assembly materials should be kept away from children except as directed by the instructions.

Nothing in these Terms replaces the instructions, warnings, labels, or safety information provided with the product.

4. Product Information and Availability

We make reasonable efforts to display and describe our products accurately, including colors, materials, dimensions, features, images, and product details. However, slight variations may occur because of screen settings, photography, lighting, production differences, packaging, or natural material variations.

Product descriptions, images, dimensions, materials, availability, pricing, promotions, and other information may be updated, corrected, limited, or discontinued at any time without prior notice.

We reserve the right to discontinue any product, limit quantities, limit sales to any person, household, geographic region, or jurisdiction, and refuse orders where permitted by law.

5. No Professional Advice

Information on our website is provided for general informational purposes only. It should not be considered medical, developmental, educational, safety, legal, or professional advice.

Parents, guardians, and caregivers are responsible for determining whether a product is suitable for their child, their home, and their intended use.

6. Orders and Payment

When you place an order, you are making an offer to purchase the selected product or products. Your order is not accepted until we confirm acceptance, process payment, and issue an order confirmation.

All orders are subject to acceptance, availability, payment approval, fraud screening, shipping limitations, and other business or legal requirements.

We reserve the right to refuse, cancel, or limit any order for any reason where permitted by law, including suspected fraud, payment issues, incorrect pricing, inventory errors, shipping restrictions, suspected resale, or violation of these Terms.

Please review your order carefully before submitting it. After an order is placed or accepted, we may not be able to accommodate cancellation or change requests.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method unless otherwise required or permitted by law.

You agree that purchases from our website are for personal or household use and not for unauthorized commercial resale, export, or distribution.

7. Pricing, Taxes, and Promotions

Prices are listed in U.S. dollars unless stated otherwise.

Prices, discounts, promotions, coupon codes, free shipping offers, bundles, and other offers may be changed, limited, suspended, or discontinued at any time without prior notice.

The price charged for a product will be the price shown at checkout at the time the order is placed, subject to correction of errors as described in these Terms.

Unless clearly stated at checkout, listed prices do not include applicable taxes, shipping charges, handling fees, customs duties, import charges, or other fees. Sales tax, where applicable, will be calculated and displayed during checkout.

Promotions may be subject to separate terms, exclusions, minimum purchase amounts, expiration dates, product limitations, or geographic restrictions. Discounts cannot be applied retroactively unless we choose to do so at our discretion. If there is a conflict between these Terms and the specific terms of a promotion, the promotion terms will apply to that promotion.

8. Shipping and Delivery

We currently ship within the United States only, unless otherwise stated on our website or at checkout.

Some addresses, including PO Boxes, APO/FPO addresses, freight forwarders, or certain remote locations, may not be eligible for delivery. If we are unable to ship to your address, we may contact you to update the details or cancel the order.

Shipping times and delivery estimates are provided for convenience and are not guaranteed unless expressly stated in writing.

We make reasonable efforts to ship orders within the timeframe stated on our website, in your order confirmation, or at checkout. If no specific shipping timeframe is provided, we will ship within the timeframe required by applicable law.

If we are unable to ship your order within the promised timeframe, we will notify you and provide options as required by applicable law, which may include agreeing to a delay or canceling the order for a refund.

Faefold is not responsible for delays caused by carriers, weather, natural disasters, customs processing, supply chain disruptions, incorrect or incomplete addresses, failed delivery attempts, refused deliveries, high-volume periods, holidays, or events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. We are not responsible for lost, delayed, misdelivered, or returned orders caused by incorrect or incomplete shipping information provided by the customer.

If a package is returned to us due to an incorrect address, failed delivery attempt, refusal of delivery, or an address that cannot be serviced by the carrier, original outbound shipping costs, carrier return fees, and reshipping fees may be deducted from any refund or charged before reshipment.

Once an order is confirmed as delivered to the shipping address provided at checkout, responsibility for the product passes to the customer, except where prohibited by law or where the issue is covered by our Shipping & Returns Policy, damage policy, or applicable consumer protection laws.

9. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Shipping & Returns Policy.

Please review our Shipping & Returns Policy before making a purchase.

Eligible items may be returned within 30 days of delivery only if they are unused, unassembled, in their original packaging, in resellable condition, and returned with all parts, inserts, instructions, and accessories included.

Because Faefold products are made from cardboard, we may refuse returns for items that have been assembled, decorated, drawn on, painted, cut, bent, damaged, exposed to moisture, or used during play, unless the item arrived damaged, defective, incorrect, or the return is due to our error.

For standard returns that are not due to damage, defect, an incorrect item, or our error, customers are responsible for return shipping costs. An outbound shipping recovery amount of up to $25 may be deducted from the refund, as described in our Shipping & Returns Policy.

Returns must be approved before being shipped back. Returns sent without prior approval, or sent to our corporate registration address instead of the fulfillment warehouse address provided by email, may not be accepted, processed, or refunded.

If there is a conflict between these Terms and our Shipping & Returns Policy, the Shipping & Returns Policy will apply to shipping, return, refund, and exchange matters.

Nothing in these Terms limits any consumer rights that cannot be limited or waived under applicable law.

10. Damaged, Defective, or Incorrect Items

If your order arrives damaged, defective, incomplete, or incorrect, please contact us within 7 days of delivery at support@faefold.com with your order number, clear photos of the shipping box, clear photos of the product and packaging, and a short description of the issue.

We may request additional information, photos, videos, or return of the item before approving a replacement, refund, store credit, or other appropriate resolution.

Please keep the product and packaging until the issue is resolved, as they may be needed for carrier claims, inspection, quality control, or product safety review.

Reports made after 7 days may be reviewed on a case-by-case basis. This does not limit any rights you may have under applicable law.

11. User Content, Reviews, Photos, and Feedback

If you submit, upload, post, tag us in, email, or otherwise provide reviews, photos, videos, comments, testimonials, ideas, suggestions, feedback, or other content to Faefold, you confirm that the content is truthful, your own, and does not violate the rights of any other person.

If your content includes a child, you confirm that you are the child’s parent or legal guardian, or that you have obtained all required permissions and consents to share that content and allow us to use it.

If you received compensation, a free product, a discount, a gift, or any other incentive in connection with your content, review, testimonial, or endorsement, you agree to clearly disclose that connection where required by law or platform rules.

By submitting content to us, tagging us, or allowing us to use your content, you grant Faefold a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, crop, adapt, publish, display, distribute, and share that content in any media, including our website, advertising, email marketing, social media, product pages, and other business or marketing materials.

You agree that we are not required to keep your content confidential, pay you for it, publish it, respond to it, or continue using it. We may remove, edit, decline to use, or stop using any content at any time.

You agree not to submit content that is false, misleading, unlawful, defamatory, abusive, obscene, invasive of privacy, infringing, harmful, or that contains viruses, malware, or any other harmful code.

12. Intellectual Property

All content on our website and services, including text, images, illustrations, product designs, graphics, logos, branding, names, slogans, photography, videos, icons, layout, and overall design, is owned by or licensed to Faefold and is protected by applicable copyright, trademark, trade dress, and other intellectual property laws.

These Terms allow you to use our website for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, sell, resell, exploit, display, publish, download, scrape, store, create derivative works from, or otherwise use any part of our website, branding, product designs, or content without our prior written permission.

Nothing in these Terms grants you any rights in Faefold’s intellectual property, Shopify’s intellectual property, or any third party’s intellectual property.

Faefold’s name, logos, product names, designs, branding, and slogans are trademarks or trade identifiers of Faefold. You may not use them without our prior written permission.

13. Copyright Complaints

We respect the intellectual property rights of others. If you believe that any material located on or linked to by our website infringes your copyright, you may submit a copyright complaint to us. To be effective, your notification must be in writing and include the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

  • Identification of the copyrighted work claimed to have been infringed;

  • Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to permit us to locate the material on the website;

  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address;

  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Our website may include or rely on third-party websites, tools, apps, payment processors, shipping carriers, analytics services, advertising platforms, embedded features, or other services.

We do not control and are not responsible for the content, accuracy, policies, security, availability, or practices of third-party websites, tools, apps, or services.

Your use of third-party services may be subject to their own terms, privacy policies, fees, rules, and practices. You access and use third-party services at your own risk.

We may offer access to optional third-party tools or features that we do not monitor or control. Such tools are provided “as is” and “as available” without warranties of any kind, and we are not liable for your use of them to the fullest extent permitted by law.

15. Relationship with Shopify

Faefold is powered by Shopify, which enables us to operate our online store and provide services to you.

Any sale or purchase you make through our store is made directly with Faefold, not with Shopify. Shopify is not responsible for any aspect of the sale between you and Faefold, including products, fulfillment, customer service, injuries, damages, losses, refunds, returns, or disputes related to your purchase from Faefold.

 

By using our website and services, you acknowledge that Shopify may process certain information as part of providing e-commerce services, as described in our Privacy Policy and Shopify’s applicable privacy terms.

16. Privacy

Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy, which is available on our website.

Because our store is powered by Shopify and may use third-party apps and services, information you submit or generate through our website may be processed by Shopify and other service providers in order to operate the website, process payments, fulfill orders, provide customer support, improve services, prevent fraud, comply with law, and support our business operations.

17. Prohibited Uses

You agree to use our website and services only for lawful purposes.

You may not use our website or services, directly or indirectly, to:

  • violate any law, regulation, rule, ordinance, or third-party right;

  • infringe or misappropriate intellectual property, privacy, publicity, or other rights;

  • submit false, inaccurate, misleading, fraudulent, or unauthorized information;

  • harass, abuse, threaten, defame, intimidate, or harm any person;

  • transmit viruses, malware, malicious code, or harmful technology;

  • interfere with or disrupt the security, functionality, availability, or operation of the website;

  • bypass, disable, or interfere with security features, access controls, CAPTCHA, robot exclusion headers, or other technical protections;

  • use bots, spiders, crawlers, data-mining tools, automated scripts, AI agents, or similar technologies to access or interact with the website without our prior written permission;

  • send spam, phishing messages, chain letters, unsolicited advertising, or other unauthorized communications;

  • purchase products for unauthorized resale, export, fraud, or any unlawful purpose;

  • use the website in a way that could harm Faefold, Shopify, our customers, service providers, or third parties.

We reserve the right to suspend, restrict, or terminate access to our website, cancel orders, or take other appropriate action if we believe these Terms have been violated.

18. Automated Access and AI Agents

No automated system, bot, crawler, scraper, AI agent, or similar technology may access, use, or interact with our website or services without our prior written permission.

If we permit automated access, the automated system must clearly identify itself, must not hide or misrepresent its identity, must not mimic human behavior to avoid detection, must not bypass technical protections, and must comply with any instructions, restrictions, or requirements we provide.

We may block, limit, or restrict automated access at any time.

19. Errors, Inaccuracies, and Omissions

Occasionally, information on our website or services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, discounts, shipping charges, transit times, availability, images, dimensions, or other details.

We reserve the right to correct errors, inaccuracies, or omissions; update or change information; refuse or cancel orders; and revise pricing or availability at any time, including after an order has been submitted, where permitted by law.

If we cancel an order because of an error after payment has been processed, we will issue a refund to the original payment method unless otherwise required or permitted by law.

20. Disclaimer of Warranties

Except as expressly stated by us in writing, and to the fullest extent permitted by law, our website, products, content, tools, and services are provided “as is” and “as available.”

We do not guarantee that the website or services will be uninterrupted, timely, secure, error-free, accurate, complete, or free from viruses or harmful components.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Some jurisdictions do not allow certain disclaimers of warranties, so some of the above disclaimers may not apply to you.

Nothing in these Terms excludes, limits, or modifies any warranty, consumer protection right, product safety obligation, or other right that cannot be excluded, limited, or modified under applicable law.

21. Limitation of Liability

To the fullest extent permitted by law, Faefold and its owners, officers, employees, contractors, partners, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages arising from or related to your use of our website, products, content, tools, or services.

To the fullest extent permitted by law, our total liability for any claim related to a product, order, website use, or service will not exceed the amount you paid to Faefold for the product or order giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Nothing in these Terms limits liability that cannot be limited under applicable law, including rights or obligations under applicable consumer protection, product liability, or product safety laws.

22. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Faefold, Shopify, and our respective owners, officers, employees, contractors, affiliates, partners, service providers, licensors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your violation of these Terms or any policy referenced in them;

  • your misuse of our website, products, content, tools, or services;

  • your violation of any law or third-party right;

  • any content, review, photo, video, testimonial, feedback, or other material you submit or allow us to use;

  • your unauthorized resale, export, or distribution of our products.

We reserve the right to control the defense and settlement of any claim subject to indemnification, and you agree to cooperate with us in defending such claims.

23. Force Majeure

We are not responsible for delays, failures, or inability to perform caused by events outside our reasonable control, including natural disasters, severe weather, fires, floods, pandemics, epidemics, labor disruptions, carrier delays, customs delays, supply chain disruptions, material shortages, internet outages, cyber incidents, payment processor issues, government actions, changes in law, war, terrorism, civil unrest, or other unexpected events.

24. Termination

We may suspend, restrict, or terminate your access to our website or services at any time, without notice, if we believe you have violated these Terms, created risk for Faefold or others, submitted false information, engaged in fraud or abuse, or used the website in an unauthorized or unlawful way.

You remain responsible for any amounts owed up to the date of termination.

The sections that by their nature should survive termination will continue to apply, including sections related to product use and safety, user content, intellectual property, copyright complaints, third-party services, Shopify, privacy, prohibited uses, errors, warranty disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and general legal provisions.

25. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date.

Where required by law, we will provide notice of material changes. Your continued use of our website or services after changes are posted means you accept the updated Terms.

26. Governing Law and Jurisdiction

These Terms, your use of the website, and any purchase made through the services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles, unless mandatory consumer protection laws of your state of residence (such as California) require the application of your local state laws. Except for disputes subject to mandatory arbitration or small claims court actions as set forth in Section 27, any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the state or federal courts located in Sheridan County, Wyoming, and you hereby consent to the personal jurisdiction and venue of such courts.

27. Dispute Resolution: Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

A. Informal Dispute Resolution: Before filing any formal claim, you and Faefold agree to try to resolve the dispute informally. You must notify us of your dispute by emailing support@faefold.com. We will attempt to resolve the issue through negotiation. If the dispute is not resolved within sixty (60) days of the email notification, either party may initiate formal proceedings as described below.

B. Binding Arbitration: You and Faefold agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach, termination, enforcement, interpretation, or validity thereof, or the use of the website or products, shall be settled by binding arbitration on an individual basis, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as expressly provided below. The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

C. Small Claims Court Exception: Notwithstanding the agreement to arbitrate, either you or Faefold may bring an individual action in a small claims court of competent jurisdiction, provided the claim remains in such court and advances only on an individual (non-class, non-representative) basis.

D. Arbitration Venue, Fees, and Costs: To ensure arbitration is not financially burdensome to you, the following rules apply:

  • Virtual Hearings: The arbitration shall be conducted virtually, via telephone, video conference, or based solely on written submissions, unless the arbitrator determines that an in-person hearing is necessary.

  • In-Person Venue: If an in-person hearing is required by the arbitrator, it will take place in the county of your residence, or in Sheridan County, Wyoming if you choose, unless applicable law requires otherwise.

  • Fees: Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules. Faefold will pay or reimburse all such AAA administrative and arbitrator fees for claims totaling less than $10,000, unless the arbitrator determines your claim is frivolous or brought for an improper purpose. You will only be responsible for the initial filing fee required under AAA Consumer Rules.

E. 30-Day Opt-Out Right: YOU HAVE THE RIGHT TO OPT OUT OF THIS AGREEMENT TO ARBITRATE. If you do not wish to be bound by this arbitration provision, you must notify Faefold in writing within thirty (30) days of the date you first place an order, create an account, or otherwise accept these Terms. Your opt-out notice must be sent via email to support@faefold.com and must include your full name, the email address associated with your account/order, and a clear statement that you wish to opt out of the arbitration agreement. Opting out of arbitration has no effect on any other part of these Terms or your obligation to follow them.

F. CLASS ACTION WAIVER: YOU AND FAEFOLD AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. Further, unless both you and Faefold agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific class action waiver is found to be unenforceable, then the entirety of this Section 27 (except for the Opt-Out Right) shall be null and void.

28. Assignment

You may not assign, transfer, or delegate these Terms or any rights or obligations under them without our prior written consent.

We may assign, transfer, or delegate these Terms and our rights and obligations to another entity in connection with a merger, acquisition, sale of assets, reorganization, change of control, or transfer of business operations, or as otherwise permitted by law.

29. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full force and effect.

30. Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

These Terms, together with our Privacy Policy, Shipping & Returns Policy, and any other policies posted on our website, make up the entire agreement between you and Faefold regarding your use of our website, products, and services.

Any ambiguities in these Terms will not be interpreted against the drafting party.

The headings used in these Terms are included for convenience only and do not limit or affect the meaning of any section.
